Trash- Craig Thomson’s week in court

On Wednesday we saw the mainstream media embrace the tactics of the prosecution in the criminal trial of Craig Thomson and seek to further trash Thomson’s name and reputation.

In what is often described as “Trash” or “Gutter Journalism” we saw pictures of prostitutes and brothel interiors and ridiculous tales of alias names and prostitutes with fake names.

What did any of this prove? Nothing

What relevance did it have to the case? None

The charges that relate to allegations of brothels have been previously investigated in NSW by the fraud squad and found to be deficient of evidence and reliant on the word of shady witnesses at best. It was determined by NSW Police that there was no criminality in these matters, including fraud. Not only this but the charges have been dismissed by the court in Victoria this week and as yet the prosecution has still yet to appeal the Magistrates decision on the dismissed charges despite being allowed time to do it.

These wild accusations were made in court by a desperate prosecution who knew that any evidence on these matters was not going to be contested as there are no charges relating to them.

Once again the prosecution has used the Magistrates Court as a stage in which to broadcast their smear campaign from in order to feed the trial by media.

I’m not going to go into these matters because they are irrelevant and any loose evidence remains untested except in NSW were the matter was dropped. Not only that, frankly I won’t explore these accusations  because I have integrity.

Yesterday it was HSU National President Chris Brown’s turn on the witness stand as evidence started to be heard in the case.

Chris Brown was the prosecution’s key witness and was the man prosecution were relying on to show that Thomson had broken the rules and did not have the authority to use his union credit card in the manner that the prosecution allege he did.

However this is not what came out.

In fact everything that Brown stated seemed to back Thomson’s defence.

The bulk of the money in question in Thomson’s charges is the amount allegedly spent on spousal travel. Brown testified that he thought that some spousal travel was entirely appropriate and there was nothing in the rules that prevented it.

One of the most important things that came out was that there was no written policy in regards to the spending of union funds at the time.

Not only that but after concerns had been raised regarding union spending and accountability it was stated that Thomson was a key player in determining how union funds could be used, and was even key in setting up the unions finance committee.

This is in stark contrast to the reckless spender he is being portrayed as in the main stream press.

So while Craig Thomson helped set up a finance committee, and set guidelines so that members funds could not be recklessly spent, his principle accuser Kathy Jackson has yet to explain her spending of over $22,000 on a ski holiday in just one month. In fact her credit card expenditure dwarfs that of Thomson.

Speaking of Thomson’s accuser Kathy Jackson, Chris Brown also stated under oath that Kathy Jackson was in partnership with Michael Williamson and that Jackson and Williamson were working together to prevent financial audits from taking place. Thomson was not part of the Williamson/Jackson alliance and was therefore a factional outcast according to Chris Brown, and seemingly a threat to their spending habits.

So it would seem that the key prosecution witness turned out to be a boost for the defence, and if that was prosecution’s key witness it’s all downhill for them from here.

If I were a Victorian taxpayer I’d be more than a bit peeved that my money was being wasted on this type of case by the DPP.

It is also interesting to note that when Thomson left the court there was no press pack waiting, none at all. No press conference, no camera’s in his face or reporters screaming questions, nothing but empty space.

When the prosecution were there to put the boot in without the need for proof in their opening statement the media were all over it. Yet as soon as evidence is introduced and things start looking good for Thomson there is no media to be found.

A trial by media will only ever promote one side of the argument.

Yesterday Magistrate Rozencwajg adjourned the case.

The trial will resume on the 20th January where it will continue until completion.

In other related news I also wanted to make my readers aware of a development on my end.

On Wednesday both Independent Australia and I received a letter from Ric Lewis of Colquhoun Murphy Lawyers acting for Michael Lawler.

This is the legal firm that represents the Liberal Pollster and strategist with a seeming fascination with 70’s Filipino porn, Mark Textor, as well as having performed legal work for Peter Costello and Tony Abbott previously.

In their letter they claim I have defamed their client in a number of my articles published online.

I note that when I have approached their client he has refused to respond and despite it being an open forum Mr Lawler has chosen not to express his views or dispute facts via the comments section as many others have done.

It is my personal opinion that this is an attempt to intimidate and bully me into not reporting on these matters any more. A motive for this perhaps being that his partner Kathy Jackson seeks to take control of the NSW Branch of the HSU after the upcoming Union election next March.

But of course that is just my opinion and I will be sending them a response today

I probably don’t need to say this, however it should be known that I would both welcome and relish the opportunity to see both Michael Lawler and Kathy Jackson in court, under oath and answering questions on these matters in a defamation proceeding, just as I’m sure many others would.

With that in mind, I would request something of all of the solicitors who would also like the opportunity to grill the Fair Work Commission Vice President and his partner the former Union Branch Secretary on the witness stand in open court and will no doubt be in contact.

Please form an orderly queue.

    Having been reading this thread regularly, I was appalled to note last night that ABC’s news fell into exactly the line you describe: “pictures of prostitutes and brothel interiors and ridiculous tales of alias names and prostitutes with fake names”. I wasn’t all that amazed, as all the ABC’s coverage of this farce has been of the same kind. My only question is: WHY? What does Aunty stand to gain by such appallingly poor reportage? I believe that’s a rhetorical question, alas …

    Immediately Pia Akerman’s disgraceful article was published in The Australian, a tweet linking to it was posted by Mark Colvin of the ABC, usually a very sober and reasonable journalist. His tweet had a mocking tone, ridiculing Thomson’s supposed use of “Jeff” as a pseudonym. When people as eminent as Colvin are as undiscriminating as this, what hope is there for the truth to come out? Peter, if you’re right about this case, the entire mainstream media including the “quality” parts of it are going to be gorging themselves on humble pie for years.

        And of course their prized evidence was a rejected credit slip in the name of Craig THOMPSON, Jeff Jackson though as confessed to FWA that he did indeed visit brothels, being married to Kathy would be enough to incite any man to do that.

        Another great post wixxy. Like you I find the “Jeff” persona unbelievable. Being of a suspicious mind, I think good old “Jeff” is the invention of a cynical imagination, possibly possessed by Jackson, Williamson or Lawlor, or all three.

        It’s unfortunate that the public broadcaster chose to join the Thomson witch hunt. We have a right to expect unbiased objective reporting from the ABC, not the muck raking mendacity practiced by the Murdoch media.

        Like joy, I feel you’ve got under some rather sensitive skins and they’re reacting like typical Liars bully boys. Keep boring into their flesh; the resulting boil will be very interesting to watch as it bursts.

    • Unfortunately that only happens in movies. Don’t get me wrong, I think Craig Thomson is innocent of the hookers charge, I think the person who used the hookers was a certain Jeff J. Who also created phony credit card vouchers which were never presented to a bank, and probably created hybrid credit card statements using photoshop and cut and paste (at least that seems the likely scenario)
      But I am not confident that Craig Thomson is going to make that defense – I think he is going to do a Nikolai Bukharin and say he was entitled to spend the money on hookers……for the good of the Union movement. I have said all along he should have got himself a conservative local solicitor from Woy Woy, who belongs to the local Liberal Party but who cares more about his legal ethics than his political affiliation, rather than all these legals hacks dependent on union patronage for their income

      Was there any cross examination? Like did you also have the HSU pay your partner’s airfares? Did the HSU ever write to Craig Thomson request he pay money back, if so when, if not why not? Who controlled the archives that you say were missing financial records when Thomson left?

    After closely following the trials of Craig in both media and courts, as professionally exposed from day one by Peter Wicks thorough investigations, I am now very angry. Angry for the Thomson family and angry at the reckless absurd treatment being dished out at him by the so called unbiased, fair mainstream media in this ‘unlucky’ country.Including the ABC who would demand the loyalty of Australians as they the supposed beacon of media fair play, crave our support against the mean wicked Murdoch/Tory attacks. Not bloody likely on current form.
    At the end of this dark chapter in our political/law enforcement thuggery. At the end of the day, when Craig is exonerated, as I am convinced he will be it is us who believe in the old fashioned notion of a fair trial by, not the media, not an agenda riddled Govt and its vengeful Ministers but us ordinary folk who must rally behind Craig and his family and ensure he has the funds to seek monetary retribution by having his day in suing those who have set out to completely destroy he and his family’s life.
    The verdict, when it comes of not guilty must be the end of the bastardy and the start of the retribution for the attackers.

    I saw (and was likewise appalled) by the ABC coverage of the Thompson case last night.

    On the one hand we have the call to ‘save our ABC’, then on the other hand we have this demonstration of trial by media from them.

    I don’t want to see my ABC following the pack in this manner. It is very distressing. Are they just trying to save their skins by toadying up to the LNP? It won’t work you know.

      Ah, Heather – my feelings exactly! This ‘trial’ is a travesty of justice in terms of media coverage, and I would’ve expected that Aunty stood head and shoulders above the rabble. I fear very much that what’s going on is someone’s decision to stop making waves in order to protect her from that other rabble, the LNP, just as you suggest. If we’re right, that someone ain’t. 😦

    It is indeed telling that the so-called media have totally ignored this day’s proceedings of Craig Thomson dodgy trial as it benefited the defence not the lascivious mindset of the despicable mainstream media. Where are the RW trolls as well? The one’s who KNOW Craig is definitely a sleazebag that is “guilty as charged m’lud”. They have been screaming that from their treetops for ages without giving us a shred of evidence of this.

    Do believe the lazy, complicit MSM have become so used to the Murdoch scumbag media setting the agenda & deciding the narrative that they continue to follow them blindly without question. Most may as well admit they are doing Murdoch’s work for him even if they aren’t on his payroll. .

    Thank you so much for your continuing excellant work on this story Peter. I am appalled that there is no msm news outlet that is reporting on this correctly, not one! You my friend are the only one giving us the facts, but please don’t win a walkly or whatever, it would degrade you. Man can I see a book/movie in this. This is of Shakespearean tragedy proportions. The decent honest simple man and the sinister evil forces that seek to destroy him! I’m not much of a commentator but an avid watcher, to me this story has much more gravitas than the Ashbygate saga, Slipper, although wrongfully treated has a lot of baggage. This is the case that if/when the truth comes out has the power to really make people see that their news media is corrupt. They will ask, why did I not know this? They will connect with Craig Thomson and be appalled that this sinister persecution of a decent man and family could happen under their very eyes and no one told them the truth.

      Heres hoping the shoe is soon very much on the other foot if Thomson sues Brandis, Lawler et scumbag al, in the mother of all defamation cases.

      I really hope there are everlasting consequences, such as lengthy jail terms and bankruptcy for those that have deeply smeared and made a living hell for what strongly appears to be an innocent man and his family.

Who but a person who wanted to be recorded as patronising a brothel would sign a credit slip in his own name and leave a record of his driver’s licence. Only a wilfully malevolent media would not see this. Not one mainstream outlet has even hinted at understanding this. Their vested interest is in having him declared a criminal in order to justify their initial errors in accepting the doctored evidence provided by Jackson. A comparison of Jackson’s assets with Thomson’s would also give cause to suspect dirty deeds. However, the ABC’s failure to investigate gives very serious cause for concern. Who is pulling the ABC’s strings that leads them to ignore all of the documentary evidence you have provided of Jackson’s corruption? Your investigations show up the mainstream journalists as water-beetles – skating across the spectacular surface of events rather than looking at what is going on underneath.

    Thomson set it up so he could simplify he’s defrauding of the union.
    No different than Wilson and the slush fund Gillard set up for him.
    It was done to simplify the removal of other peoples moneys to benifit ones self.
    Tell me what decent man would use his members funds who he was charged with using appropriately on prostitution?
    Every time he purchased anything on that HSU union issued credit card he would have known if it was work related or not.
    I say cigarettes , dirty movies and prostitutes are not work related.
    Cathy Jackson, a hard working and honest union representative knew that to.
    Hence her reporting the fraud to the appropriate authority.
    A fat lot of good her honesty did her.
    Anybody remember the shovel on her porch or the bashing of Bob. kernahan or the bullets in his letterbox?
    Thomson and his supporters and you can lump that other fraudster Gillard in there as well have thrived on the inaction of honest people.
    Simply because of threats made by them and their brethren.
    No more, over the next couple of years they will be shown by the majority of Australians we will no longer stand by why you steal from us.
    If you think Thomson or a Gillard or a Williamson or a Shaw or any of their ilk are honest.

  18. Are you arguing that Craig is innocent and is being persecuted? Or are you really complaining about the media treatment of the case?

    I would agree with you on the later, the media circus surrounding this case is astounding, especially for what is a simple fraud case.

    Is he innocent? I doubt he is innocent, but it wouldn’t matter even if he was guilty, he won’t be doing serious prison time if convicted and there are far more important criminal cases underway and pending in the future.

    As an intelligent, insightful and brave man, you would no doubt have realised that what Lawler is attempting to do to you, is what the Tories have attempted to do to Craig. That is, break a man for their ongoing benefit, be it political, as in the Thomson case, or personal and social, as it seems to be gearing up to in your case.

    As you have correctly pointed out, Lawler is using the same miscreant bunch of legal ambulance chasers that Abbott & Costello used in their Defo cases in the early part of the Howard years as an intimidatory tactic to silence their critics and scrutineers.

    I know you won’t fall for it because it is a matter of principle to stand up for what is right. And you are a man of principle.

    I would probably be correct in assuming that you realise that this is all just another case of the conga line of legal proceedings that the Tories have honed to a fine art, using the law, not for justice, but for retribution, and to get their favoured sons, such as the ‘Golden Child’ of the privileged in our society whom we have had foisted upon us as our Prime Minister now, Tony Abbott, off any legal scrapes they get themselves into. The law is not an ass, but an asset to them to that end.

    Make no mistake, as well as destroy your deserved reputation, as they have tried to do with Craig, they will also use the law against you as a blunt instrument to beggar you. Another of their favoured tactics.

    Never fear, there are still QCs around who haven’t accepted the Tories bag of silver to compromise their ethics and morals, and I am sure they will come out of the woodwork to represent you, hopefully pro bono, against the Establishment thugs who seek to silence your voice.

    Never doubt that we have all got your back, Peter. For you are fighting the good fight.

    Why is so much publicity being given to brothels, when is only forms a tiny part of the prosecution charges. Now, surely buying a ice cream is just as big a crime.

    By the way, I thought they magistrate struck out the charges allegedly committed in NSW. Is that not where the brothels are found.

    Why is it adjourned to late January? Why not finished the matter now?

    Yes, he is lining up Gillard and allegations that occurred over two decades ago.

    He is lining up a inquiry into the HSU.

    I think there is one into the Building Trades. I think it might be inte the Grocon workers, in particular.

    One into the Insulation schemes, alleging that Labor is responsible for the four deaths.

    Where is the one for the Ashby, Pyne and Bought matter.

    Where is the one for Alexander Downer. He said he was dismissing the allegations regarding Timor. Said they were old allegations from the past.

    News for Downer, so are the one against Gillard and Thomson., Difference is, these ones have been investigated many times before this, and no evidence of wrong doing found.

    Maybe Abbott should review investigations into wheat sales to Irak, during the years of sanctions.

    Abbott nerds to be careful of these types of investigations. They mostly have a life og theior own, revealing different results, to those expected.

    Remember the one against the Painters and Dockers in Victoria. Led to the revelation of the Bottom of the Harbour schemes, and many business being caught in the trap. Do not remember many union officials being harmed. And yes, I do believe that was a corrupt union. Trouble was, that those on the business side were more corrupt.

    Same thing occurring in NSW with Obied inquiries. Many more business men, and even politicians on the right , being caught, than Labor politicians.

    I will say to HSU members, you are responsible and should be alert to what is occurring in your union. Make is your business to ensure it is run above board.

    Seems that there are still too many of the old brigade still around.

    Sorry, but I gad to have my rant.
